These terms govern your use of merchhaus.store and any purchase you make from Merchhaus. By using the store or placing an order, you agree to them. Nothing in these terms limits the rights you have under the Consumer Protection Act 68 of 2008 (CPA) or the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

1. Who we are

This store is operated by [Registered company name] (registration number [registration number]), trading as Merchhaus. Our full business details are in our Legal Notice. Email: hello@merchhaus.co.za. The store runs on Shopify's e-commerce platform.

2. Using our store

You agree to use the store lawfully and not to interfere with its security or operation, copy its content, or use automated tools to buy products in bulk. We try to keep the store accurate and available, but we can't guarantee it will be free of errors or interruptions.

3. Products

We describe and photograph products as accurately as we can. Colours may look slightly different on screen, and sizes may vary slightly between garment styles and batches. Please check the size guide before ordering. Stock is limited, especially for tour and Fan Club items, and we may limit the quantity per customer.

4. Prices and payment

  • All prices are in South African rand (ZAR) and include VAT where applicable.
  • Delivery fees are shown at checkout before you pay.
  • Payment is processed securely through Shopify's checkout by our payment provider. We do not see or store your full card details.
  • If a product is listed at an obviously incorrect price, we'll contact you before processing the order. You can then pay the correct price or cancel for a full refund.

5. When a contract is formed

Your order is an offer to buy. The contract is formed when we send you an order confirmation email. We may decline an order, for example if an item is out of stock or we suspect fraud. If we decline after you've paid, we'll refund you in full.

6. Pre-orders

  • Pre-order items are paid for in full when you order.
  • Each listing shows an estimated dispatch or pickup date. This is an estimate, not a guarantee.
  • If a pre-order will be more than 14 days late, we'll tell you and you may cancel for a full refund.
  • If we can't fulfil a pre-order at all, we'll refund you in full.

7. Event pickup

  • Where offered, you can choose to collect your order at a specific event, such as a concert venue. The pickup location, date and collection point are shown at checkout and in your confirmation email.
  • To collect, show your order confirmation (on your phone is fine) and a valid ID in the name on the order.
  • Someone else can collect for you if you email us their name beforehand. They must show your order confirmation and their own ID.
  • Orders can only be collected at the event you selected. If you can't make it, contact us within 7 days after the event. We can arrange delivery at your cost, or collection from us in Cape Town by arrangement.
  • If we don't hear from you within 30 days after the event, we may cancel the order and refund the purchase price, less any costs we reasonably incurred.

8. Delivery

Delivery is covered in our Shipping Policy. Ownership and risk pass to you on delivery or collection.

9. Fan Club

Fan Club membership is personal and can't be transferred. Members-only products are for personal use, not resale. We may change Fan Club benefits, or suspend access for misuse, at any time.

10. Custom and branded orders

Custom and branded corporate orders aren't sold through this store. They're quoted separately and governed by the terms in the quote and on merchhaus.co.za.

11. Intellectual property

All content in this store, including the Merchhaus name, logo, text and images, belongs to Merchhaus or its licensors. Artist merchandise designs belong to the relevant artists or rights holders. You may not copy or use any of it without written permission.

12. Cancellations, returns and refunds

Your right to cancel an online order within 7 days (the ECTA cooling-off period), and your rights for defective goods, are set out in our Refund Policy.

13. Liability

To the extent the law allows, Merchhaus is not liable for indirect or consequential loss arising from the use of our store or products. Our total liability for any order is limited to the amount you paid for it. This does not limit liability we can't exclude by law, including under the CPA.

14. Privacy

We handle your personal information in line with our Privacy Policy and POPIA.

15. Disputes and governing law

These terms are governed by South African law. If something goes wrong, please contact us first so we can try to fix it. If we can't resolve it, you may approach the Consumer Goods and Services Ombud or the National Consumer Commission, or the courts of South Africa.

16. Changes to these terms

We may update these terms from time to time. The version on this page when you place an order applies to that order.
